Terms and Conditions of Participation for the “Adventcalendar 2026” Prize Draw

1. Subject Matter

These terms and conditions of participation exclusively govern participation in the “Adventcalendar 2026” prize draw (“Sweepstakes”) organized by Tri d’Aix GmbH, Poststraße 43, 52477 Alsdorf, Germany (hereinafter referred to as the “Organizer”), as well as the use and collection of the data requested from and provided by participants.

By participating in the Sweepstakes, participants agree to these terms and conditions of participation and to the privacy policy.

The Organizer is responsible for the distribution of prizes as well as for the organization, handling, and provision of the prizes.

2. Participation

Eligible to participate are natural persons who are resident in Germany and have reached the age of 18. Participation is not limited to customers of the Organizer and does not depend on the purchase of any goods or services. If a participant’s legal capacity is restricted, the consent of their legal representative is required.

Excluded from participation in the Sweepstakes are employees of the Organizer as well as employees of cooperation partners who are or were involved in the creation or handling of the Sweepstakes, and their relatives.

The Organizer reserves the right to exclude persons from participation if legitimate reasons exist, for example:
(1) in the event of manipulation in connection with access to or execution of the Sweepstakes,
(2) in the event of violations of these terms and conditions of participation,
(3) in the event of unfair conduct, or
(4) in the event of false or misleading information provided in connection with participation in the Sweepstakes.

Participation in the Sweepstakes is only possible online and takes place via the website Tri d’Aix – One of the Largest Candy Assortments.

Participation in the Sweepstakes takes place by entering title/salutation, first name, last name, address, phone number, and email address.

The participant is always considered to be the person who entered their personal data in the participation form and submitted it bindingly by clicking “Sign up.”

Participation in the Sweepstakes is free of charge, with the exception of the respective internet connection costs.

3. Course of the Sweepstakes

The opportunity to participate ends at the close of December 31, 2026.

Participation in the Sweepstakes is only possible by individuals.

Participation is only possible within the participation period. Entries received after the participation deadline will not be considered in the drawing.

Each participant may only participate once.

The Organizer reserves the right to cancel, interrupt, or terminate the Sweepstakes at any time without prior notice and without giving reasons, and to adjust the terms and conditions of participation at any time for good cause. This right will be exercised in particular if proper execution of the Sweepstakes cannot be guaranteed for technical reasons (e.g., hardware/software errors) or for legal reasons.

4. Prize, Notification, and Delivery of the Prize

Prizes during the promotional period September 1, 2026 – December 31, 2026:

The prizes raffled are one latest-generation iPhone, four Sweet Stories® gumball machines including a matching gumball refill pack, and ten surprise packages containing products from our range.

The winners will be determined in early January 2027 by means of a random drawing among all participants.

Winners will be notified of their prize by email or telephone, using the email address or phone number provided. Prizes will be shipped within one week after the address details have been reconfirmed, following receipt of the confirmation email.

The Organizer bears the costs incurred for shipping the prizes.

Cash payment or exchange of the prizes is not possible. The right to a prize or to a replacement prize cannot be transferred. However, the Organizer reserves the right to substitute prizes if reasons beyond the Organizer’s control make this necessary.

If the winner does not respond within two weeks after the prize notification email has been sent, via the email address registered for the Sweepstakes, to reconfirm their postal address, the claim to the prize lapses and a new winner will be determined by drawing among all participants. The same conditions apply to the notification and shipment of the prize to the newly determined winner as applied to the originally determined winner.

The Organizer reserves the right to publish the winners’ first and last names on tri-d-aix.com. Consent to this is deemed granted upon participation in the Sweepstakes.

Early termination or cancellation of the Sweepstakes: The Organizer points out that the availability and functioning of the Sweepstakes cannot be guaranteed. The Organizer is entitled to cancel, suspend, or modify the Sweepstakes early, without this giving rise to any claims by participants against the Organizer, if unforeseen circumstances beyond the Organizer’s control occur that make the originally planned execution more difficult or unreasonable for the Organizer. This includes, in particular but not exclusively, unauthorized third-party interference, technical problems with hardware or software beyond the Organizer’s control, as well as legal violations directly connected with the execution of the Sweepstakes, in particular manipulative interference with the course of the Sweepstakes.

5. Liability

The Organizer shall not be liable for:
a. Errors in the transmission of data
b. Technical malfunctions of any kind
c. Damage to a participant’s or any other person’s computer arising from participation in the Sweepstakes
d. Theft or destruction, as well as unauthorized access to or alteration of participant data

The Organizer shall be liable without limitation to the extent that the cause of damage is based on intent or gross negligence.

Subject to items (a) and (b) above, the Organizer shall be liable for slightly negligent breaches of material obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for breaches of obligations whose fulfillment enables the proper execution of the Sweepstakes and on whose compliance the contracting parties regularly rely. In this case, however, the Organizer shall only be liable for foreseeable damage typical for this type of contract. The Organizer shall not be liable for slightly negligent breaches of obligations other than those specified in the preceding sentences.

The above limitations of liability do not apply to injury to life, body, or health, to defects following the assumption of a guarantee for the quality of a product, and to fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

To the extent that the Organizer’s liability is excluded or limited, this shall also apply to the personal liability of the Organizer’s employees, representatives, and agents.

6. Privacy Notice

The Organizer collects and uses participants’ data for the purpose of conducting the Sweepstakes. Any further collection and use of data will only take place if participants consent to it.

The following data is collected from participants by the Organizer and is used for the design, execution, and handling of the Sweepstakes: title/salutation, first and last name, address, phone number, and email address.

Once the data is no longer required for handling the Sweepstakes, it will be deleted. Where data must be retained for legal reasons, it will be blocked and deleted after the expiry of the applicable tax and commercial law retention periods. Your data will not be passed on to third parties for advertising purposes unless you have expressly consented to further use. Tri d’Aix GmbH assures that your data will be handled with the utmost care and used only for the purpose of processing the Sweepstakes, after which it will be deleted or blocked.

The privacy policy of this website shall additionally apply.

7. Final Provisions

Questions or complaints in connection with the Sweepstakes should be directed to Tri d’Aix GmbH as part of The Fini Company.

The Sweepstakes is governed exclusively by the law of the Federal Republic of Germany. Recourse to legal action is excluded.

Severability Clause

Should any provision of these terms and conditions of participation be or become invalid, in whole or in part, the validity of the remaining terms and conditions of participation shall not be affected. In place of the invalid provision, the legally permissible provision that comes economically closest to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a gap in these terms and conditions of participation.
